Proposed Changes to the Gwydir Local Environmental Plan 2013 (GLEP) - Planning Proposal (PP)-2024-881
What area does the Planning Proposal apply to?
This Planning Proposal applies to the whole of the land located within the Gwydir Shire Local Government Area.
What are the proposed changes?
A Planning Proposal must be prepared in order to rezone land or change existing planning development standard or to include or remove clauses that apply to the land in a Local Environmental Plan.
This Planning Proposal has the following objectives and intended outcomes for the GLEP:
- To enable more efficient and expeditious development assessment by Gwydir Shire Council by reallocating some non-adverse impact and low-impact development to the exempt development category in the GLEP.
- To simplify development approval requirements and facilitate the construction of appropriate rural infrastructure with minimal external impacts.
The proposed outcomes will be achieved by including development types along with appropriately limiting development controls in Schedule 2 – Exempt Development Codes of the GLEP. These development types include balconies, decks, patios, pergolas, terraces, verandahs, cabanas, cubby houses, ferneries, garden sheds, gazebos, greenhouses, carports, driveways, hard stand spaces, farm buildings, grain silos, grain bunkers and fences.
The Exempt Development Codes are proposed to apply to one and/or more of the existing land use zones including RU1 Primary Production, RU5 Village, R5 Large Lot Residential, E4 General Industrial, RE1 Public Recreation and RE2 Private Recreation.
Because the Planning Proposal includes the amendment of a State Environmental Planning Policy Council will not be the local plan making authority. The responsible authority for the plan making will be the Minister for Planning and Public Spaces.

How to Make a Submission
Submissions must be received in writing, addressed to the General Manager and include the reference number PP-2024-881.

Before making a submission, you are encouraged to read the attached Planning Proposal and all associated documentation.
Please note that the inclusion of personal information within your submission is voluntary. However, if not provided, Council will not be able to contact you about the proposal. The information will be stored in Council’s electronic records systems and paper files. For your protection, Council recommends that you do not include defamatory comments in your submission.
Any submission about this proposal may contain information that is personal information, such as information that identifies you, etc, for the purposes of the Privacy & Personal Information Protection Act 1998. Confidentiality is not available to respondents. The details of any submission may be included in a Council report or forward to the proponent where it may assist in identifying and/or resolving issues with regards to the proposal. Information (including copies of submissions) may also be released in accordance with the Government Information (Public Access) Act 2009.
Will my submission stop the Planning Proposal from progressing?
Council must consider any and all valid submissions, that are received prior to the close of the exhibition period, in deciding whether to amend the proposal, proceed without amendments or to abandon the proposal. Submissions that are considered are balanced with Council’s statutory obligations, the rights of the proponent and the public interest.
Who will make the determination on whether the GLEP will be amended?
As part of the Gateway Determination the Minister for Planning and Public Space as been appointed as the Local Plan Making Authority.
